First; it is my will that my funeral expenses and all my just debts to be fully paid.
Second; After the payment of such funeral expenses and debts, I give,
devise and bequeath unto my beloved wife, Sarah Ann Hughes, all my personal
property of what nature, or kind soever, with full power to sell and dispose
of the same, at public or private sale, at such time, or times, and upon
such terms, and in such manner as to her shall seem best. And from
the proceeds of said sales to pay all my just debts, and the legacy hereinafter
specified and I further give, devise and bequeath unto her the use, occupation,
profits and
rent, of all my real estate, with full power to encumber the same
by mortgage, or otherwise, to any extent or sum necessary for her liberal
and just support and maintenance during her life, and at her death such
of the real and personal estate as may remain non-expended by her,
I give, devise and bequeath to my children to be divided equally
between them share and share alike.
Third; I give, devise and bequeath unto my daughter Sarah R. Hughes the sum of Two Hundred Dollars in consequence of her care and attention to my aged and much respected mother, Elizabeth Hughes, to be paid by my executrix within a reasonable time after my death.
Fourth & Lastly; I do hereby nominate and appoint my beloved
wife Sarah Ann Hughes executrix of my last will and testament, hereby revoking
all former wills made by me.
In witness whereof, I have hereunto set my hand and seal this Fourth
day of May, A.D. 1878.
